What Is Wisconsin Divorce Mediation?

Mediation is a form of alternative dispute resolution (ADR) that involves a neutral third party who finds similarities between the two debating parties and attempts to reach a fair agreement between the dispute. The role of the mediator is to work with disputing parties to interpret apprehensions, relay information between the two spouses that may not be on the greatest terms, and to define the problems of the dispute. The ultimate goal is to come to a fair and just agreement before having to go through the anxiety of a trial.

How Can Wisconsin Mediation be Helpful in Divorce?

Mediation is generally the best way to settle arguments in divorces and the fees of mediation are much less than the fees of actually going to trial. Mediation will help both parties save time and money while settling the divorce.

The goal of any mediation is to leave with a signed agreement between the two parties. If no agreement has been reached, then the parties must go to trial. Your mediators are not allowed to be called to witness in the trial and nothing debated in your mediation will be discussed at the trial. Your mediator is also not allowed to discuss your personal information with the other party; your confidentiality is of utmost importance to us.

It is wise to settle divorces that involve child custody issues through divorce mediation in Wisconsin. Although the marriage is ending, you are still the parent of a child that is also going through the turmoil of divorce. Statistics show that parents who don’t go through trial and come to child custody agreements through mediation report generally happier living situations. Our lawyers are concerned with both your well-being and the happiness and comfort of your child. We understand that divorce can be complicated and our goal is to make it as painless as possible for both you and your child.

We have offices equipped for both private consultations and for mediations where both parties can collaborate. Mediation generally takes a limited number of sessions, while going through a trial could take weeks. At Derr & Villarreal, LLC, we strive for couples going through a divorce to come to an agreement through mediation before going through a trial.
